There are many differences between being charged by the state and the federal government. Most importantly, the federal government has vast resources, and they take their time building a case before bringing one (in most cases). The state deals with every arrest that comes through the door and in many locations in Florida the state has enough on its plate.

However, the federal government takes its time and builds its case, and if you wait too long to deal with an investigation, matters could become much worse.

    Protecting Your Rights

Do not assume that a court appointed attorney will have the time to help you through the numerous steps in a federal criminal trial, which has a different set of procedural rules than the state does. Instead, choose an attorney that is dedicated and experienced enough to help you through the legal process. With years of experience and a passion for protecting your rights, you can count on Wenzel Law for any federal criminal charges you are facing.

    Federal Classes of Crimes

The federal criminal code recognizes five classes of felony offenses (A, B, C, D, and E) and three classes of misdemeanor crimes (A, B, and C). A Class A crime is the most serious and carries the greatest punishment.

    Category:
    Class
    Maximum Sentence:
    Felony
    A
    Death or Life imprisonment
    Felony
    B
    25 years or more

    C

    Felony
    D
    5 to 10 years
    Felony
    E
    1 year to 5 years
    Misdemeanor
    A
    6 months to 1 year
    Misdemeanor
    B
    30 days to 6 months
    Misdemeanor
    C
    5 days to 30 days

    Federal Sentencing

Another incredibly important distinction between state and federal cases relates to sentencing.

A defendant may face mandatory minimum penalties and the federal sentencing guidelines can often result in very long prison sentences. A plea deal can be negotiated but like in the state system, the court must accept the deal. Even so, at this level the federal judge will decide the appropriate sentence by considering the sentencing guidelines and other additional factors. Finally, if convicted and sentenced to a term of imprisonment, a defendant will be placed in the custody of the U.S. Bureau of Prisons to serve their sentence.
